New law closing OTT streaming services loophole implemented

The economics ministry says that a new law preventing Taiwanese broadcasters and distributors from selling Chinese over-the-top (OTT) services has been implemented.

The new law grants the National Communications Commission power to investigate cases related to Chinese firms trying to use local partners to broadcast OTT content in Taiwan. 

The Chinese firms the Taiwanese government is trying to block include iQiyi and Tencent Video. Since iQiyi’s application to launch operations in Taiwan in 2016 was rejected, the firm has been working with a local distributor as a way to bypass the National Communications Commission.

According to the Act Governing Relations between the People of the Taiwan Area and the Mainland Area, the National Communications Commission can fine violators between NT$50,000 and NT$5 million (US$1,703 and US$170,300) and demand that all operations be halted or corrected.
