Legal representative consent no longer required for same-sex marriage

Legal representative consent is no longer required for marriage or divorce for same-sex couples in Taiwan. This change passed on Tuesday in an amendment to the law that legalized same-sex marriage.

The original law passed in 2019 and says two people of the same sex may establish a permanent union with intimacy and exclusivity for the purpose of living together and register for marriage with the household authorities. 

The new article specifies that the consent of the legal representative is not required for the establishment or termination of same-sex marriages between the ages of 18 and 20. The implementation date has been backdated for January 1, 2023.

The legislature also voted last week to legalize same-sex adoption. The bill, amending the current same-sex marriage law, will allow gay couples to adopt children with the same rights under the Civil Code.
