Wednesday is Chinese New Year’s Eve, a national holiday, but some people still have to work. The Ministry of Labor is reminding employers that they must give overtime pay for those who have to work during the Chinese New Year holiday.
The labor law states the four days beginning Chinese New Year’s Eve to the third day of the New Year are national holidays. Employers should pay employees for those days and give overtime pay for those who have to work at that time.
The ministry also said those who work during national holidays are entitled to a holiday the following day. If the following day is also a national holiday, then it can be moved to the nearest day or a day agreed upon between the employer and employee. Employees must be allowed to make up for the work during the holiday or be given overtime pay.
If employers do not adhere to these labor laws, employees can report the company to the labor ministry.
